The Rich Samaritan Organization is a Christian nonprofit committed to providing humanitarian and charitable assistance to refugees and displaced persons in accordance with biblical principles of compassion, stewardship, and integrity (Galatians 6:10; Luke 10:33–35).
This policy establishes safeguards and limitations regarding the transfer and use of financial assistance in foreign countries to ensure responsible stewardship of donated funds and to limit the Organization’s liability for misuse beyond its control.
This policy applies to:
· All monetary assistance transferred internationally
· All recipients, partners, intermediaries, or beneficiaries of aid
· All donors, customers, sponsors, or contributors funding such assistance
Funds distributed by the Organization are restricted to the specific humanitarian purposes disclosed to and approved by the Organization, which may include:
· Basic living necessities (food, shelter, clothing)
· Medical care
· Emergency relief
· Education or resettlement support
· Other mission-aligned refugee assistance
Recipients acknowledge that any use outside the disclosed and approved purpose is unauthorized.
All recipients of financial assistance, whether individuals or partner organizations, must acknowledge that:
1. They bear sole responsibility for the use of funds once received.
2. Funds must not be used for:
· Any unlawful activity under U.S. law or the law of the receiving country
· Terrorism, armed conflict, or political activity
· Personal enrichment unrelated to the disclosed humanitarian purpose
3. The Organization does not control or supervise expenditures after disbursement beyond reasonable due diligence measures.
Due to the nature of international aid and operating conditions in foreign jurisdictions, the Organization:
· Cannot guarantee oversight of all downstream uses of funds
· Relies in good faith on representations made by recipients or intermediaries
· Is not responsible for undisclosed, unwarranted, or unauthorized actions taken after funds are transferred
All donors, customers, sponsors, or contributors (“Contributors”) expressly agree that:
1. The Organization shall not be liable for:
· Misuse, diversion, or unlawful use of funds by recipients
· Actions or omissions of third parties receiving aid
· Uses of funds not disclosed to or approved by the Organization
2. Contributors release, hold harmless, and indemnify the Organization, its officers, directors, employees, volunteers, and agents from any claims, losses, penalties, or damages arising from:
· Unauthorized or illegal use of transferred funds
· Transactions or activities beyond those disclosed to the Organization
· Regulatory or legal actions resulting from recipient misconduct not caused by the Organization’s negligence or willful misconduct
The Organization commits to:
· Reasonable due diligence consistent with its size and resources
· Compliance with applicable U.S. laws, including sanctions and anti-money laundering regulations
· Periodic review of international aid practices
However, compliance efforts do not constitute a guarantee of recipient conduct.
The Organization affirms that all aid is distributed in prayerful good faith, seeking to honor God through faithful stewardship. While accountability is pursued, the Organization recognizes that moral agency ultimately rests with the recipient.
Recipients and partners are encouraged to report known misuse of funds. The Organization reserves the right to:
· Suspend or terminate aid
· Decline future assistance
· Cooperate with lawful investigations when required
This policy shall be governed by and interpreted under the laws of the State of Alaska, United States, without regard to conflict-of-law principles.
Participation in any donation, sponsorship, or funding transaction constitutes acknowledgment and acceptance of this policy.
To the fullest extent permitted by law, all donors, customers, sponsors, and contributors (“Contributors”) expressly acknowledge and agree that:
1. Assumption of Risk
Contributors understand that financial assistance provided in high-risk or unstable regions involves inherent risks, including limited oversight, diversion, coercion, corruption, or misuse beyond the Organization’s control.
2. Release of Liability
Contributors irrevocably release and discharge the Organization, including its officers, directors, employees, volunteers, agents, and affiliates, from any and all claims, demands, liabilities, penalties, fines, damages, or causes of action arising out of or related to:
· The unauthorized, undisclosed, or unlawful use of funds by recipients or intermediaries
· Actions taken by third parties after funds are transferred
· Any violation of local, foreign, or international law by recipients not caused by the Organization’s gross negligence or willful misconduct
3. Indemnification
Contributors agree to defend, indemnify, and hold harmless the Organization from and against all losses, costs, investigations, enforcement actions, regulatory penalties, legal fees, or damages arising from:
· Recipient misuse or diversion of funds
· Transactions or activities not disclosed to or approved by the Organization
· Any claim that funds were used for prohibited, sanctioned, or unlawful purposes without the Organization’s knowledge or intent
4. No Agency Relationship
Recipients and intermediaries are not agents, employees, or representatives of the Organization, and no liability shall be imputed to the Organization for their actions.
The Organization is a faith-based ministry. Decisions regarding charitable assistance are made prayerfully and in accordance with biblical stewardship principles. Nothing in this policy creates a secular fiduciary, agency, or partnership relationship beyond the Organization’s religious mission.
Aid is given in faith and good conscience. While accountability is pursued, recipients remain morally and legally responsible for their actions before God and governing authorities.
The Organization operates exclusively for charitable purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code. All assistance is intended for humanitarian relief and not for private benefit, political activity, or prohibited purposes.
By completing this transaction, you acknowledge and agree that:
· Donations supporting international refugee aid are used in good faith for humanitarian purposes as disclosed.
· Once funds are transferred internationally, the Organization does not control or supervise their downstream use.
· The Organization is not responsible or liable for unauthorized, undisclosed, or unlawful use of funds by recipients or third parties.
· You release and agree to indemnify and hold harmless the Organization from any claims, losses, penalties, or damages arising from recipient misuse or illegal activity not caused by the Organization’s willful misconduct.
· Donations may be suspended or redirected if legal, safety, or compliance concerns arise.
The Organization conducts reasonable due diligence to comply with applicable U.S. laws, including but not limited to:
· Office of Foreign Assets Control (OFAC) sanctions
· Anti-money laundering (AML) requirements
· Counter-terrorism financing laws
However:
· The Organization relies on information reasonably available at the time of transfer.
· The Organization does not warrant or guarantee that recipients will remain compliant after receipt of funds.
· Contributors acknowledge that liability shall not attach to the Organization for post-transfer violations committed by recipients without the Organization’s knowledge, intent, or direct involvement.
The Organization reserves the right to:
· Decline, suspend, or terminate assistance
· Request additional documentation
· Cooperate with lawful authorities when required
We give generously and responsibly to help refugees in difficult places around the world. Because international aid often involves unstable conditions, we cannot control how funds are used once they reach recipients.
We do our best to:
· Vet partners and recipients
· Follow U.S. and international laws
· Use donations for the purposes we disclose

Aid Recipients acknowledge that:
· Funds may not be used for unlawful, undisclosed, or unauthorized purposes
· Any use outside the approved scope is prohibited
· Moral, legal, and financial responsibility for fund usage rests solely with the Aid Recipient upon receipt
This covers refugees, non-refugees, partners, and intermediaries equally.
The Organization shall not be liable for:
· Misuse, diversion, or unlawful use of funds by any Aid Recipient
· Acts or omissions of any third party following disbursement
· Activities or transactions not disclosed to or approved by the Organization
This applies regardless of whether assistance is provided to refugees or non-refugees.

Contributors agree to defend, indemnify, and hold harmless the Organization from all claims, investigations, enforcement actions, and legal expenses resulting from recipient misconduct or undisclosed use of funds.
4. No Agency Relationship
Aid Recipients are not agents or representatives of the Organization.
The Organization provides assistance in faith and good conscience, seeking to honor God through compassion and stewardship. While accountability measures are implemented, Aid Recipients remain fully responsible before God and governing authorities for their actions.
By completing this transaction, you acknowledge and agree that:
· Donations support humanitarian assistance to individuals and communities in need, including refugees and non-refugees.
· The Organization does not control or supervise the use of funds after transfer.
· The Organization is not liable for misuse, diversion, or unlawful use by any recipient.
· You agree to release and indemnify the Organization from claims arising from recipient conduct beyond the Organization’s control.
We provide humanitarian assistance to people and communities in need—both refugees and non-refugees—guided by faith, compassion, and responsible stewardship.
Because aid is often delivered in challenging environments, we cannot control how funds are used after they reach recipients. We take reasonable steps to give wisely and lawfully, but recipients remain responsible for their actions.
